but not limited to agricultural land, golf courses, CSD-owned lands(i.e.,parks,open space, street a <br /> landscaping, etc.), other public or private lands and open spaces, and/or discharge treated <br /> wastewater directly into Old River on a partial or year-round basis. Subject to the obtaining of a <br /> wastewater discharge permit from the appropriate other governmental entities,this policy is <br /> vested as to the Property,unless a change in said policy is required by changes in state and <br /> federal law, as set forth in Section 2.5.2. of this Agreement, or for reasons of health and safety, <br /> asset forth in Section 2.5.4. of this Agreement. <br /> D <br /> 8. Water Provisions: The Master Plan provisions for the quantity of the a <br /> Community's water supply are Vested Elements, and are sufficient to satisfy the County's current <br /> water policy with respect to the development of the Property. Future County water policies or <br /> proposed subdivision map conditions which conflict with said Master Plan provisions or this a <br /> Agreement shall not be applied to the Property unless required by federal or state law as set forth <br /> in Section 2.5.2 of this Agreement or for reasons of health or safety as set forth in Section 2.5.4 a <br /> of this Agreement. <br /> 9. Regional Park: The regional park requirements as set forth 1n the Master <br /> Plan are vested as constituting the full requirements to be imposed on the development of the <br /> Property with respect to the regional park. Notwithstanding the foregoing, in the event the <br /> County establishes a valid county-wide regional park program or in-lieu fee program for regional <br /> parks, then Developer shall participate in such park program or in-lieu fee program,with <br /> appropriate pro-rata credit to be given for Developer's participation in the past or future a <br /> implementation of the regional park requirements of the Master Plan. <br /> 10. The Affordable Housing Ordinance adopted as of May 26, 1998, as . <br /> amended. <br /> 11. The Policies, Objectives, Implementation and Project Requirements set a <br /> forth in Section 3.9.2. of the Jobs/Housing Section of the Master Plan. <br /> 12.
