The proposed <br /> development lies within the boundaries of the District. If the application is approved and <br /> the area is rezoned for homes the development must be detached from the District prior <br /> the building of the homes. The applicant must act as the agent for this detachment and <br /> include any areas adjacent to the proposed detachment that would become land locked <br /> from the District as a result of the detachment. <br /> The applicant must provide easements to the District for existing facilities that currently <br /> run through the proposed development and pay all costs to relocate any of the facilities if <br /> they deemed necessary and the District concurs. <br /> Current District facilities include open canals and the applicant shall provide adequate <br /> right of ways to the District for ongoing maintenance and construct adequate fencing <br /> along the right of ways to separate the development for liability and operational concerns. <br /> The District provides irrigation water and agricultural drainage facilities in that area. The <br /> proposed development must not impede these facilities in any way.
