CONDITIONS OF APPROVAL <br /> PA-0900165 <br /> Hieb <br /> Y <br /> Minor Subdivision Application No. PA-0900165 was approved by the San Joaquin County <br /> Community Development Department on September 11, 2009. The effective date of approval is <br /> September 21, 200% This tentative map approval will expire on September 20, 2012, which is three <br /> years from the effe6tive date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> i prior to approval of, the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. TENTATIVE,MAP: The Parcel Map shall substantially conform to the approved tentative map dated <br /> July 12, 2009` <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map: <br /> All persons purchasing lots within the boundaries of this approved map should be prepared to accept <br /> k the inconveniences or discomforts associated with agricultural operations or activities, such as noise, <br /> odors, insects, dust or fumes. San Joaquin County has determined that such inconveniencies or <br /> discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The followinglot size and width regulations shall apply to this map: <br /> k <br /> (1) Parcel One shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> (2) Parcel One shall be between two (2) net acres and five (5) gross acres in size. (Development <br /> Title Section 9-610.3[a)) <br /> d. TRANSFER"RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> The homesite shall not be transferred until, or upon the death of an owner owning at least <br /> fifty (50) percent interest in the hornesite parcel, unless the homesite parcel and the <br /> remainder parcel are merged pursuant to the provisions of the Development Title. <br /> The property°shown on the Parcel Map is restricted from further subdivisions for homesite <br /> purposes, except for financing only, by Section 9-610.3 of the San Joaquin County <br /> Development Title. <br /> e. NOTICE OF NON-RENEWAL: A Notice of Non-renewal for all parcels below the ten (10) <br /> acre minimum parcel size will be required in conjunction with the contract.
