CONDITIONS OF APPROVAL <br /> PA-02-551 <br /> Diamond <br /> Minor Subdivision Application No. PA-02-551 was approved by the San Joaquin County Community <br /> Development Department on January 9, 2003. The effective date of approval is January 19, 2003. <br /> This tentative map approval will expire on January 18, 2006, which is three years from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jose Rubianes, 953-7509) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved Tentative Map <br /> dated November 8, 2002. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of two hundred (330) feet, measured at the front yard <br /> setback line. (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 4.9 gross acres as approved in Variance Application <br /> No. VR-01-03 by the Planning Commission on January 17, 2002. <br /> c. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot wide private easement for access to Parcel Two along Parcel One shall be <br /> shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) A proposed 25-foot wide private easement for access to Parcel Three along Parcel Two shall be <br /> shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (3) A proposed 25-foot wide private easement for access to Parcel Four along Parcel Three shall be <br /> shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> d. STORM DRAINAGE: Any additional storm water drainage created by new improvements shall be <br /> retained on-site. The drainage pattern and corresponding storm drain improvements shall be shown <br /> on the Site Plan. Drainage calculations prepared by a registered civil engineer or architect shall be <br /> included. (Development Title Section 9-1135) <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> Conditions of Approval - 1 - PA-02-551 <br />
