VR-92-2 OF <br /> THOMAS AND IRENE SHEPHARD <br /> ----------------------------------------------------------------- <br /> The Development Services Division has completed its review of <br /> this Variance Application to vary the minimum parcel size from 40 <br /> acres to 0. 95 acres and 0. 69 acres. After reviewing all <br /> application materials and pertinent sections of the Planning <br /> Title, the Development Services Division will be recommending <br /> that this variance be denied based on the inability to make all <br /> of the required findings in the affirmative. <br /> Findings: <br /> 1. Because of the special circumstances applicable to the <br /> property, including size, shape, topography, location or <br /> surroundings, the strict application of the zoning <br /> regulation deprives the property of privileges enjoyed by <br /> other property in the vicinity and under identical zoning <br /> classification. <br /> This finding cannot be made because there are no <br /> special circumstances applicable to the property that <br /> deprive the property owner of any privileges enjoyed by <br /> other properties in the vicinity. There are no <br /> physical or geographical circumstances that preclude <br /> this parcel from supporting one residence. <br /> 2. The granting of the Variance will not constitute a grant of <br /> special privileges inconsistent with the limitations upon <br /> other properties in the vicinity and zone in which the <br /> property is situated. <br />
