58. The developer shall build the required drainage system and water quality basins as required <br /> by MHCSD to accommodate runoff from the project. <br /> 59. Water Quality Basins Mosquito Abatement: Plans for the implementation and maintenance of <br /> the water quality basins and any other storm drainage facilities involving open bodies of water <br /> shall be reviewed and approved by the MHCSD and if required by the Mosquito Abatement <br /> District. <br /> 60. All non-residential (i.e. Office, Industrial, Commercial, etc), uses must enter into an NPDES <br /> storm water agreement with MHCSD. <br /> 61. UTILITIES <br /> A. The Developers and contractors shall comply with Ordinance No. 4162"Street <br /> Opening and Pavement Restoration Regulations". <br /> B. When any portion of an arterial street is to be included in a developments <br /> construction plans, then all of the buried utilities that are ultimately planned to be <br /> within the improvement area shall be installed as part of the street improvement <br /> project, regardless of any of the utilities needed for any phase of the development <br /> associated with the street construction. Conduits or sleeves may be installed in lieu <br /> of the buried utility, if approved by the MHCSD Public Works Director. <br /> C. Any phased development shall install all "in-tract" utilities needed to serve its <br /> development. In addition, if any future adjacent or nearby phases of the <br /> development, or adjacent Neighborhoods, will depend on obtaining service from such <br /> utilities, then the utility lines shall be sized to serve these future developments. Any <br /> utility lines that are intended to be used by an adjacent development or <br /> Neighborhood shall be installed up to the phase or Tentative Map boundary line to <br /> make it available for future extension. To recoup all or a portion of any over sizing <br /> costs, the developer may request the MHCSD to process a reimbursement <br /> agreement pursuant to the MARA. A Water Volume and Pressure Analysis shall be <br /> approved by the MHCSD for any phasing of the water system that is not served by <br /> completed portions of the Water Master Plan. If sufficient parameters are not met, <br /> then additional portions of the Water Master Plan may have to be completed, as <br /> determined by the MHCSD Public Works Director. <br /> D. When public utilities are to be located outside public rights-of-way but within the <br /> Tentative Map boundary, the developer shall provide public utility easements for <br /> these utilities. The easements shall be shown on all Final Maps and parcel maps. <br /> Prior to the submittal of improvement plans for the development, the developer shall <br /> submit to the MHCSD composite to-scale schematic plans for in-tract and outside the <br /> tract all storm drains, sanitary sewers, and water distribution facilities, both in plan <br /> and profile Any discovered conflicts shall be corrected prior to plan approval. <br /> E. Electrical transformers within residential Neighborhoods shall be in underground <br /> vaults, subject to MHCSD and Modesto Irrigation District(MID) requirements. The <br /> developer shall pay for any incremental costs relating to undergrounding <br /> transformers not paid for by MID. <br /> F. Transformers located in the downtown area, commercial and industrial areas may be <br /> placed above ground provided they are aesthetically designed and/or shielded by <br /> landscaping subject to MHCSD and MID requirements. <br /> Conditions of Approval -16- <br />
