CONDITIONS OF APPROVAL <br /> MS-92-55 <br /> EDWARD FAGUNDES <br /> Unless otherwise specified, all Conditions of Approval shall be <br /> complied with prior to the approval of the Parcel Map. <br /> Those Conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance Requirements. Ordinance <br /> Requirements cannot be modified. <br /> 1 . DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Planning Title Section 9- <br /> 9112) <br /> b. Remainder shall be designated as "Designated Remainder" <br /> on Parcel Map. (Subdivision Map Act Section 66445) <br /> C. The Traffic Impact Mitigation Fee will be required when <br /> parcels are developed. The fee is due and payable at <br /> the time of building permit application. (The fee <br /> currently is $2 , 164 . 00 per single family dwelling unit <br /> in the Tracy area. The fee shall be automatically <br /> adjusted July 1 of each year by the Engineering <br /> Construction Cost Index as published by the Engineering <br /> News Record. ) (Resolution R-90-304) <br /> d. The frontage improvements for MacArthur Drive across <br /> Parcel 1 shall be constructed in conformance with the <br /> standards for one-half of a 60 foot right-of-way rural <br /> street. The construction of the frontage improvements <br /> will be deferred upon execution by the owner of a <br /> Deferred Frontage and Roadway Improvement Agreement or <br /> a Secured Deferred Frontage and Roadway Improvement <br /> Agreement with a deposit equivalent to their estimated <br /> construction costs prior to approval of the Parcel Map. <br /> (A $250 . 00 fee is currently required for processing per <br /> Planning Title Section 9-10502 in addition to a copy of <br /> the Grant Deed and an estimate for the required <br /> frontage improvements. The estimate shall be prepared <br /> by a Registered Civil Engineer with a typical section <br /> drawing on a form to be supplied by the Public Works <br /> Department and submitted to the Public Works Department <br /> for approval. As an option the Department of Public <br /> Works will prepare the drawing and estimate for an <br /> additional fee of $100. 00 . ) (Planning Title Section 9- <br /> 9204) <br /> e. All easements of record shall be shown on the Parcel <br /> Map. (Planning Title Section 9-9184) <br /> f . Requirements for construction of improvements shall be <br />
