Revision of Approved Actions : Rose QX-91-2 2 . State the facts showing the changes in circumstances which make the subject conditions (s) no longer appropriate or necessary. Request revision to conditions 1 (L) and 2 (b) 1 (L) The hours of operation shall be from 5 : 00 a.m. to 9 : 00 p.m. daily, except during period of declared national, state, or county emergency. 2 (b) Load on MacArthur Drive shall be restricted to the legal load limit. Due to changing market forces and the need for continuity in its operations , Teichert seeks an amendment to its Conditions of Approval to allow for 24-hour operation and the removal of the weight restriction for crossing MacArthur. As staff is aware, Teichert is in the process of designating and bringing on line its Vernalis operation (QX-91-5) . Recent events and circumstances may lead to a modification of the project start-up time for Vernalis . Teichert--in collaboration with the Public Works Department of San Joaquin County, Caltrans, Lonestar, Granite, and Brown Sand & Gravel--is analyzing a beneficial traffic throughput directly onto I-5 . While we are assessing this opportunity and its associated costs, Teichert's operation south of Linne Road must continue to supply the market . Changing conditions in the vicinity of the Tracy Rock Plant will mean that current hours of operation are not sufficient to allow Teichert to meet its project demand. To that end Teichert requests the flexibility to utilize a 24-hour clock. Safety and efficiency prompt this request. Even though the intensity of operations is not expected to increase, we need the ability to work around the traffic congestion which will result when the Waste Discharge Facility commences operations this summer. Transport of material from Rose via scrapers can be accomplished most safely during those hours when waste disposal vehicles are not making heavy use of the road. The time frame for this request is strictly limited by the remaining reserves available to be mined. It is Teichert's goal to bring Vernalis on line as soon as possible, and at that point the facilities at Tracy will phase out. Upon the conclusion of crossing the road with scrapers, Teichert will repair and/or replace the affected road section.
