C. Dedication to result in a 42-foot-wide right-of-way from the centerline of MacArthur Drive <br /> to the property line is required across the frontage of Assessor's Parcel No. 253-210-15. <br /> (Development Title Section 9-1150.5) <br /> d. An encroachment permit shall be required for work within the road right-of-way. <br /> (Development Title Section 9-1145.4) <br /> e. A video tape of road conditions on MacArthur Drive, across the frontage of Assessor's <br /> Parcel No. 253-210-15, is required prior to the start of excavation. The condition of <br /> MacArthur Drive shall be reviewed with the Department of Public Works prior to the start <br /> of excavation. (Development Tale Section 9-1415.2) <br /> I. A bond or cash deposit in the amount acceptable to the Department of Public Works shall <br /> be filed with the Department with a guarantee that R the permittee fails, refuses, or <br /> neglects to repair, under permit, any damages to MacArthur Drive that may result from <br /> the permittee's operations, including vehicular crossing of MacArthur Drive, the <br /> Department of Public Works may do the work necessary to restore MacArthur Drive equal <br /> to, or better than, its original condition, using the funds from said bond or cash deposit. <br /> (Development Title Section 9-854.3) <br /> g. The Traffic Impact Mitigation Fee will be required for this development. The fee currently <br /> is $161.30 per daily trip-end in the Tracy area. The fee shall be automatically adjusted <br /> annually by the Engineering Construction Cost Index as published by the Engineering <br /> News Record. No excavation is permitted into the ground water table without specific approval from the <br /> Regional Water Quality Control Board, Central Valley Region Water Code, Chapter 4, <br /> Article 3, Section 13240. <br /> b. The materials from an excavation shall not be deposited into any water course nor in any <br /> way contribute to the pollution thereof (California Water Code, Section 13376). <br /> C. An approved potable water supply must be provided for all employees(Development Title <br /> Section 9-1100.1). <br /> d. Approved sanitary facilities must be provided for all employees (Development Title Section <br /> 9-1100.1) <br /> e. Open, pump, and backfill the septic tank, seepage pit, or excavation under permit and <br /> inspection by the Environmental Health Division(Development Title Sections 9-1110.3 and <br /> 9-1110.4). <br /> f.
