Dedicate a 42-foot-wide right-of-way from the centerline of Mac Arthur Drive to the property line across the frontage of Assessor's Parcel No. 253-210-15. (Development Title Section 9-1150.5) 4. An encroachment permit shall be required for work within the road right-of-way. (Development Title Section 9-1145.4) 5. A video tape of road conditions on Mac Arthur Drive, across the frontage of Assessor's Parcel No. 253-210-15, is required prior to the start of excavation. The condition of Mac Arthur Drive shall be reviewed with the Department of Public Works prior to the start of excavation. (Development Title Section 9-1415.2) 6. A bond or cash deposit in the amount acceptable to the Department of Public Works shall be filed with the Department with a guarantee that if the permittee fails, refuses, or neglects to repair, under permit, any damages to Mac Arthur Drive which may result from the permittee's operations, including vehicular crossing of Mac Arthur Drive, the Department of Public Works may do the work necessary to restore Mac Arthur Drive equal to, or better than, its original condition, using the funds from said bond or cash deposit. (Development Title Section 9-854.3) 7. The Traffic Impact Mitigation Fee will be required for this development. The fee currently is $161.30 per daily trip-end in the Tracy area. The fee shall be automatically adjusted annually by the Engineering Construction Cost Index as published by the Engineering News Record.
