The proposed project entails removal <br /> of approximately 7,600,000 cubic yards of sand and gravel from a 156.90 acre site over <br /> a six year period. The depth of excavation averages 48 feet. The site is adjacent to an <br /> existing Teichert Aggregates quarry and currently supports an apricot orchard. <br /> The reclamation plan satisfies the majority of requirements of the Surface Mining <br /> and Reclamation Act of 1975 (SMARA)(Public Resources Code (PRC) Section 2710 et <br /> seq.) and the State Mining and Geology Board regulations for surface mining and <br /> reclamation practice (California Code of Regulations (CCR) Title 14, Chapter 8, <br /> Article 1, Section 3500 et seq.; Article 9, Section 3700 et seq.). Financial assurance <br /> calculations, however, are not provided in the reclamation plan. PRC Section 2773.1 <br /> requires that financial assurances be required of all surface mining operations to <br /> guarantee site reclamation. OMR is authorized to review cost estimates prior to lead <br /> agency approval of the financial assurance for reclamation. The financial assurance <br /> mechanism must include both the lead agency and the Department of Conservation as <br /> obligees. To be acceptable it should read: "San Joaquin County or the Department of <br /> Conservation." The operator should not be listed as an obligee. Pursuant to CCR <br /> Section 3805, please forward to OMR all worksheets, engineering estimates, contractor <br /> bids, unit costs, labor-hours, equipment types, etc., used to determine the assurance <br /> amount. <br /> Please send a copy of the approved reclamation plan, response to our <br /> comments, and permit issued by you as lead agency under SMARA to the Office of <br /> Mine Reclamation at 801 K Street, M.S. 09-06, Sacramento, CA 95814-3529. The <br /> approved documents will be placed in the OMR files pursuant to the Surface Mining <br /> and Reclamation Act. <br />
