i <br /> Revised ConditiOhs of Approval <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kevin Swanson, 468-9653) <br /> a. APPROVED USE: This approval is for Quarry Excavation to remove approximately one million <br /> cubic yards of,rock, sand, and gravel from approximately 89 acres in three phases over a period <br /> of 18 44 years from the effective date of approval as shown on the plan dated September 17, <br /> 2010 2992, and the reclamation plan dated September 17, 2010 2002 <br /> b. RIPARIAN HABITAT: Parallel to the Mokelumne River, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide for nesting and foraging habitat and <br /> the protectior`of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100)feet, measured from the mean high water level of the natural bank, or fifty (50) feet back from <br /> the existing riparian habitat,whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. The rq,0an high water level and the edge of the riparian habitat shall be shown on the Site <br /> Plan. The open space buffer required above shall be shown on the Site Plans with the following <br /> note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> The proposed berm shall be located outside the required open space area. <br /> c. CULTURAL RESOURCES: If, in the course of development, concentrations of prehistoric or <br /> historic-period rrmaterials are encountered, all work in the vicinity of the find shall halt until an <br /> archaeologist:can evaluate the materials and make recommendations for further action. If human <br /> remains are encountered, all work shall halt in the vicinity, and the County Coroner shall be notified <br /> immediately.,,-t the same time, a qualified archaeologist shall be contacted to evaluate the finds. If <br /> human burials:are found to be of Native American.origin, steps shall be taken pursuant to Section <br /> 15064.5(e)of Guidelines for California'Environrriental Quality Act. <br /> d. STOCKPILING: No stockpiled soil or material shall be placed closer than twenty-five(25) feet to a <br /> property boundary. (Development Title Section 9-1415.3[b]) <br /> e. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as to control <br /> the creation of.dust. The first one hundred (100)feet of any private road on the property which <br /> intersects with a publicly maintained road shall be surfaced in a manner approved by the Director. <br /> Traffic-control;<and warning signs shall be installed, if required, at such intersections. The placement <br /> and size of these signs shall be approved by the Director of Public Works. (Development Title <br /> Section 9-14'15.3[c]) <br /> f. EROSION CONTROL: Protective vegetative planting, silt screen darns, or other approved methods <br /> shall be required where necessary for the control of erosion. An erosion and sediment control plan <br /> approved by Development Services Division shall be part of the reclamation plan. (Development Title <br /> Section 9-141'6.3[d]) <br /> g. PERFORMA4CE STANDARDS: Standards contained in Chapter 9-1025 shall be met unless <br /> otherwise modified by conditions of the Quarry Excavation Permit.
