i Revised ConditiOhs of Approval 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kevin Swanson, 468-9653) a. APPROVED USE: This approval is for Quarry Excavation to remove approximately one million cubic yards of,rock, sand, and gravel from approximately 89 acres in three phases over a period of 18 44 years from the effective date of approval as shown on the plan dated September 17, 2010 2992, and the reclamation plan dated September 17, 2010 2002 b. RIPARIAN HABITAT: Parallel to the Mokelumne River, a natural open space area for riparian habitat and waterway protection shall be maintained to provide for nesting and foraging habitat and the protectior`of waterway quality. The minimum width of said open space shall be one-hundred (100)feet, measured from the mean high water level of the natural bank, or fifty (50) feet back from the existing riparian habitat,whichever is greater. Water-dependent uses may be permitted in this buffer. The rq,0an high water level and the edge of the riparian habitat shall be shown on the Site Plan. The open space buffer required above shall be shown on the Site Plans with the following note: Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is designated as a natural open space for riparian habitat and waterway protection. No development other than water dependent uses shall be permitted in this space. The proposed berm shall be located outside the required open space area. c. CULTURAL RESOURCES: If, in the course of development, concentrations of prehistoric or historic-period rrmaterials are encountered, all work in the vicinity of the find shall halt until an archaeologist:can evaluate the materials and make recommendations for further action. If human remains are encountered, all work shall halt in the vicinity, and the County Coroner shall be notified immediately.,,-t the same time, a qualified archaeologist shall be contacted to evaluate the finds. If human burials:are found to be of Native American.origin, steps shall be taken pursuant to Section 15064.5(e)of Guidelines for California'Environrriental Quality Act. d. STOCKPILING: No stockpiled soil or material shall be placed closer than twenty-five(25) feet to a property boundary. (Development Title Section 9-1415.3[b]) e. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as to control the creation of.dust. The first one hundred (100)feet of any private road on the property which intersects with a publicly maintained road shall be surfaced in a manner approved by the Director. Traffic-control;<and warning signs shall be installed, if required, at such intersections. The placement and size of these signs shall be approved by the Director of Public Works. (Development Title Section 9-14'15.3[c]) f. EROSION CONTROL: Protective vegetative planting, silt screen darns, or other approved methods shall be required where necessary for the control of erosion. An erosion and sediment control plan approved by Development Services Division shall be part of the reclamation plan. (Development Title Section 9-141'6.3[d]) g. PERFORMA4CE STANDARDS: Standards contained in Chapter 9-1025 shall be met unless otherwise modified by conditions of the Quarry Excavation Permit.
