The court agreed that the permit approval fell under the <br /> Class 1 exemption, stating: <br /> We presume that thousands of permits are renewed each year for the ongoing <br /> operation of regulated facilities, and we discern no legislative or regulatory <br /> directive to make each such renewal an occasion to examine past CECW <br /> compliance at every facility built in the last 24 years.
