CONDITIONS OF APPROVAL <br /> PA-0200182 <br /> REED LEASING GROUP LLC / GEORGE REED , INC . <br /> Revisions of Approved Actions No . PA-0200182 was approved by the Planning Commission on July <br /> 189 2024 . The effective date of approval is July 18 , 2024 . This approval will expire on December 31 , <br /> 2038 , unless ( 1 ) all Conditions of Approval have been complied with , ( 2) all necessary building permits <br /> have been issued and remain in force , and (3) all necessary permits from other agencies have been <br /> issued and remain in force. <br /> Unless otherwise specified , all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits . Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application . Ordinance requirements cannot be modified , and other ordinance requirements may <br /> apply . <br /> 1 . COMMUNITY DEVELOPMENT DEPARTMENT ( Staff Contact : [209 ] 468 - 3121 ) <br /> a . APPROVED USE : This approval is for a Quarry Excavation to remove approximately one million <br /> cubic yards of rock , sand , and gravel from approximately 89 acres in three phases over a period <br /> of 20 33 years as shown on the revised site plan dated September 17 , 2010 May 5 , 2015 , and <br /> the amended reclamation plan dated May 4 2 February 9 , 2024 . The site shall be fully <br /> reclaimed by December 31 , 2038 . <br /> b . RIPARIAN HABITAT : Parallel to the Mokelumne River , a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide for nesting and foraging habitat <br /> and the protection of waterway quality . The minimum width of said open space shall be one - <br /> hundred ( 100 ) feet , measured from the mean high water level of the natural bank , or fifty ( 50 ) <br /> feet back from the existing riparian habitat , whichever is greater . Water- dependent uses may be <br /> permitted in this buffer . The mean high water level and the edge of the riparian habitat shall be <br /> shown on the Site Plan . The open space buffer required above shall be shown on the Site Plans <br /> with the following note : <br /> Pursuant to Section 9 - 1510 . 5 of the San Joaquin County Development Title , this area is <br /> designated as a natural open space for riparian habitat and waterway protection . No <br /> development other than water dependent uses shall be permitted in this space . <br /> The proposed berm shall be located outside the required open space area . <br /> c . CULTURAL RESOURCES : If , in the course of development , concentrations of prehistoric or <br /> historic- period materials are encountered , all work in the vicinity of the find shall halt until an <br /> archaeologist can evaluate the materials and make recommendations for further action . If <br /> human remains are encountered , all work shall halt in the vicinity , and the County Coroner shall <br /> be notified immediately . At the same time , a qualified archaeologist shall be contacted to <br /> evaluate the finds . If human burials are found to be of Native American origin , steps shall be <br /> taken pursuant to Section 15064 . 5 ( e ) of Guidelines for California Environmental Quality Act . <br /> d . STOCKPILING : No stockpiled soil or material shall be placed closer than twenty- five ( 25 ) feet to <br /> a property boundary . ( Development Title Section 9 - 1415 . 3 [b] ) <br /> e . PRIVATE ROADS : All private roads involved in an excavation shall be maintained so as to <br /> control the creation of dust . The first one hundred ( 100 ) feet of any private road on the property <br /> which intersects with a publicly maintained road shall be surfaced in a manner approved by the <br /> Director .
