Mr. <br /> Bongcaron stated that if aerosol cans cannot be fully used due to damage, they are thrown in the trash. No container <br /> was observed on site for the collection of waste aerosol cans. Hazardous wastes shall be disposed of only by <br /> transportation to a permitted hazardous waste treatment, storage, and disposal facility (TSDF). Immediately cease <br /> disposal of hazardous waste to the trash and ensure that all future waste is hauled by a licensed hazardous waste <br /> transporter to a permitted TSDF. <br /> This is a Class I violation. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> Black staining was observed on the asphalt surrounding the used oil tank and under engines stored in the yard behind <br /> the shop. Puddles and stains of used oil were observed throughout the floor in the shop pit storage area. Absorbent <br /> granules and rags were observed spread throughout the pit area, some fully saturated with used oil. Facilities shall <br /> be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, <br /> or surface water which could threaten human health or the environment. Immediately clean all stained areas, removed <br /> stained soil, collect all used oil and spent absorbent, and manage these wastes according to Title 22 hazardous <br /> waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. <br /> This is a repeat violation, Class 11. <br /> 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. <br /> Two plastic buckets of used oil and were observed next to the used oil tank without lids. The used oil tank was <br /> observed with an open bung hole; the bung could not be located at the time of inspection. A bucket of used oil mixed <br /> with trash was observed in the shop pit storage area without a lid. All hazardous waste containers shall be closed at <br /> all times except when adding or removing waste. Immediately close these containers and ensure all hazardous waste <br /> containers are closed when not adding or removing waste. <br /> This is a repeat violation, Class 11. <br /> 501 CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. <br /> The facility does not have a tank assessment for the used oil tank. Mr. San estimated the tank to be 400 gallons. <br /> The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed and certified by an <br /> independent, qualified, professional engineer, registered in California attesting that the system has sufficient structural <br /> integrity, is acceptable for the transferring, storing, and treating of hazardous waste, and that the tanks and <br /> containment system are suitably designed. Immediately have an assessment prepared for the used oil tank.
