RECEIVED <br /> San Joaquin valley MAY 2 7 2005 <br /> Air Pollution Control District Community Development Dept. <br /> 4, 2005 <br /> Reference tt: N20050394 <br /> Raymond Hoo <br /> San Joaquin County <br /> Community Development Department <br /> Development Services Division <br /> 1810 East Hazelton Avenue <br /> Stockton, CA 95205 <br /> SUBJECT: PA-0400789 (SU) & PA-0400248 (ZR) APPLICATION TO <br /> CHANGE APROXIMATELY 27 ACRES OF FOUR PARCELS <br /> INTO 105 RESIDENTIAL LOTS, A SCHOOL SITE, AND A <br /> DETENTION BASIN. <br /> Dear Mr. Hoo: <br /> The San Joaquin Valley Air Pollution Control District (District) has reviewed the <br /> proposed projects and offers the following comments: <br /> The San Joaquin Valley's air quality has been designated nonattainment by the EPA <br /> and by the Air Resources Board (ARB) for 03 (ozone) and PM-10 (fine particulate <br /> matter, dust). The Federal Clean Air Act (CAA) and the California Clean Air Act require <br /> areas that are designated nonattainment to reduce emissions until standards are met. <br /> Based on the information provided, it appears that this project will have a less-than- <br /> significant impact on the ambient air quality. However, the construction phase of this <br /> project can generate emissions from the movement of soil, use of heavy equipment, <br /> bulk materials handling, asphalt paving and other related activities. As a result, this <br /> project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose of <br /> Regulation VIII is to reduce the amount of fine particulate matter (PM-10) entrained into <br /> the ambient air from man-made sources. Please be advised that the District's <br /> Governing Board approved amendments to Regulation VIII, Rules 8011-8061 and <br /> 8071-8081; respectively, that became effective on October 1, 2004. Of particular <br /> note are amendments to Rule 8021 (see section 6.3.1); the Dust Control Plan <br /> threshold has changed from 40.0 acres to 10.0 or more acres for residential sites. <br /> If a residential site is 1.0 to less than 10.0 acres, an owner/operator must provide <br /> written notification to the District at least 48 hours prior to his/her intent to begin <br /> any earthmoving activities (see section 6.4.1). The attached Compliance Assistance <br /> Bulleting (CAB) highlights many of the requirements contained within Regulation VIII. <br /> The CAB is not meant to be all inclusive, but it can be a useful compliance aid in the <br /> David L.
