w. This development is subject to reapportionment under the San Joaquin Area Flood Control Agency Assessment District No. 96-1 (Flood Protection Restoration Project). An application requesting the reapportionment of the unpaid portion of the assessment, along with payment of the reapportionment fee, shall be provided prior to approval of the Final Map. x. The applicant/developer shall pay their fair share for the cost of widening Del Mar Avenue to provide for one left-turn land and one right-tum lane, prior to approval of the Improvement Plans. The fair share amounts to$5,671.00. y. A State National Pollutant Discharge Elimination System(NPDES) Construction Permit Notice of Intent shall be filed with the State Route Resources Control Board if over one acre of total ground is disturbed. z. This subdivision, including streets, is subject to the Count Storm Water Quality Control Criteria Plan, which requires treatment, filtration, or infiltration of the 85 percentile storm and post-construction Best Management Practices. aa. The abandoned portion of Walker Lane shall have all necessary utilities relocated to the new Walker Lane, and the area east of the new Walker Lane shall be merged to the existing parcels, prior to approval of the Final Map. NOTE: Any construction activity that results in the disturbance of at least one acre of soil shall require a State NPDES construction permit. 3. ENVIRONMENTAL HEALTH DEPARTMENT(Staff Contact: Michael Escotto,468-3443) a. The Surface and Subsurface Contamination Report dated November 15, 2004,was deemed incomplete. Prior to a Final Map, an addendum shall be submitted to and approved by the Environmental Health Department. b. Written confirmation is required from Public Works that improvements have been constructed or financial arrangements have been made for any improvements for public sewer required by the agency. In addition, written confirmation from Public Works that the agency has or will have the sewer capacity to serve the development is also required. (Development Title Section 9-1100.3) c. A letter from the water supplier will be required stating that they have the capacity to serve the development and that the system meets State standards prior to recording the final map. The applicant shall provide Environmental Health written documentation that the potential hazardous materials(oil drums, above ground tanks, etc.)mentioned in the Surface and Subsurface contamination report shall be properly disposed of in accordance with California State laws prior to Final Map approval. e. Open, pump, and backfill the septic tank,seepage pit, or excavation under permit and inspection by Environmental Health prior to Final Map approval.
