3. CALIFORNIA STATE DEPARTMENT OFFISH AND GAME <br /> a. The California Department of Fish and Game has reviewed the project. They state in part, "The <br /> project will result in the conversion of open-space agricultural lands to non-open space use. This <br /> conversion will result in significant cumulative impact to wildlife habitat. The recently adopted San <br /> Joaquin Multi-Species Conservation Plan (SJMSCP) requires that the loss of agricultural land be <br /> compensated through payment of fees. These fees will be used to establish wildlife habitat <br /> preserves which will compensate for loss of habitat." <br /> b. Given the above determination and the California Environmental Quality Act (CEQA) <br /> requirements, the project's applicant has two options: <br /> (1) Participate in the SJMSCP; or <br /> (2) Consult with the Department of Fish and Game and agree on mitigation measures that will <br /> ensures that impacts are mitigated below a level of significance in compliance with CEQA. <br /> 4.
