Recommendations <br /> Action <br /> It is recommended that the Planning Commission deny the appeal. <br /> Previously Approved Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the proposed use may be permitted in the AU-20 zone <br /> with an approved Site Approval. The AU-20 zone is an implementing zone for the AU/R <br /> General Plan designation. San Joaquin County has no Master Plans, Specific Plans, or <br /> Special Purposes. Plan affecting the site. Additionally, the proposed project does not <br /> require intensive capital improvements in order to operate. It is a Condition of Approval <br /> that the use will end if the zone is changed to a zone that does not permit the use. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because adequate area exists on the project site to install a <br /> storm drainage pond and a septic system for the office building. Also, the property has <br /> frontage along a County maintained road, and the Department of Public Works is requiring <br /> an Irrevocable Offer and Agreement to Dedicate the Road that will result in a 42-foot-wide <br /> right-of-way from the centerline of Manthey Road. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the site is large enough at 3.1 acres to accommodate <br /> the proposed use and the improvements such as parking, septic system, and the storm <br /> retention pond. Additionally, it is a Condition of Approval that the use will end if the zone <br /> is changed to a zone that does not permit the use. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts. The Environmental Health Department and <br /> the Department of Public Works also did not identify any public health or safety issues <br /> that would result from approval of the proposed project. <br /> 5. The use is compatible with adjoining land uses. <br /> • This finding can be made because the proposed use is conditionally permitted in the AU- <br /> 20 zone. The property is in an area that contains agricultural parcels used for farming <br /> purposes. Also, with the Conditions of Approval, the proposed use will not interfere with <br /> or alter the current uses on adjacent agricultural properties.
