Master Water Plan adopted by CITY on November 17 , 1986 , ( Resolution No . 86 -- 0702 ) , expressly incorporated by reference as part of this agreement , shall provide the general guidelines for planning and development of water supply sources and transmission facilities subject to such modifications as may be necessary to meet future conditions and growth within the service area . 6 . CONSTRUCTION OF TRANSMISSION LINE TO STOCKTON EAST WATER DISTRICT SEWD CITY shall develop plans and specifications for the South Stockton Aqueduct to connect to the SEWD Plant in accordance with the PLAN . Within two ( 2 ) years of execution of this agreement , COUNTY may request that CITY oversize the South Stockton Aqueduct and extend it such that it will provide ser - vices for the Lathrop - Manteca areas . Contract ( s ) for the construction of the transmission line shall be awarded within three ( 3 ) years of COUNTY notification as to the oversizing and extension of the South Stockton Aqueduct , 7 . COVENANT OF COOPERATION , The parties to this agreement do hereby covenant to complete all actions necessary to comply with the provisions of this agreement . Be CITY TO ADMINISTER CONSTRUCTION PROJECTS . CITY shall fund and administer this agreement and shall do all acts reaso - nably necessary to the proper execution for the maximum public benefit and the common purpose of this agreement . CITY shall design , call for bids , make award of contract and administer the construction projects as provided in paragraphs 3 and 6 of this agreement . 9 . OWNERSHIP OF FACILITIES . A . COUNTY hereby grants to CITY the following irrevocable rights : 1 . To use , for transmission of CITY water , all of COUNTY ' s off - site facilities located within the area covered by PLAN as shown in Exhibit " D " , incorporated by reference herein . 2 . To provide service to new customers from the COUNTY ' s off - site facilities , as shown in Exhibit " D " ; and 3 . To expand and / or extend COUNTY - owned lines which are shown in Exhibit " D " , as deemed necessary to CITY to fulfill its obligation under this agreement and /or to provide service to new areas . Be All facilities constructed by CITY Ipursuant to this agreement shall be owned by CITY . Notwithstanding the irrevo- cable right- granted in this clause the COUNTY shall retain ownership of the facilities shown in Exhibit " D " . 3 -
