It would appear that the excavation <br /> will result in a substantial lowering of the land surface such that the resulting proximity of the <br /> water table to the surface may adversely impact the farming of the land. RD 684 cannot be <br /> expected to use its assessments to respond to drainage inadequacies caused by deliberate actions <br /> of the owners to lower the land surface. <br /> If it is expected that the land will remain drained and in productive agriculture,provisions <br /> (including funding for installation, operation and maintenance) should be made to assure that a <br /> separate drainage system and pump will be installed to pump water from the drains for the <br /> lowered fields into the RD 684 drainage system. <br /> A covenant running with the land should be recorded to assure that the separate drainage <br /> system will be properly installed, operated and maintained and that the landowners acknowledge <br /> that RD 684 will not make improvements to its drainage system to respond to water table <br /> proximity to land surface caused by the subject excavation. <br />
