.wo
San Joaquin Valley
Air Pollution Control District
April 20, 2000 unrarJAN 3 O ZQ02
C"v/n,"
Jose Rubianes
San Joaquin County
Community Development Department
Development Services Division
1810 East Hazelton Avenue
Stockton, CA 95205
SUBJECT: SA-01-97 SIERRA ORGANICS COMPANY
Dear Mr. Rubianes:
The San Joaquin Valley Air Pollution Control District (District) has reviewed the proposed
project and offers the following comments:
The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by
the Air Resources Board (ARB) for 03 (ozone) and PM-10(fine particulate matter, dust).
The Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are
designated nonattainment to reduce emissions until standards are met.
It appears as if the operational phase of this project would generate emissions from the
movement of soil, use of heavy equipment, bulk materials handling, and other related
activities. As a result, this project is subject to District Regulation VIII (Fugitive Dust
Prohibitions). The purpose of Regulation VIII is to reduce the amount of fine particulate
matter (PM-10) entrained into the ambient air from man-made sources. The attached
Synopsis highlights many of the requirements contained within Regulation VIII. Regulation
VIII has recently been revised, with the revisions become effective May 15, 2002. The
applicant may review these changes at the District web site www.vallevair.org.
This facility would be subject to District Rule 4102 (Nuisance). The purpose of this rule
is to protect the health and safety of the public and applies to any source operation
which emits or may emit air contaminants or other material. A possible violation could
occur if the project proponent discharges quantities of air contaminants which cause the
following nuisances:
David L. Crow
Executive Director/Air Pollution Control Officer
Northern Region Office Central Region Office Southern Region Office
4230 Kiernan Avenue, Suite 130 1990 East Gettysburg Avenue 2700 M Street, Suite 275
Modesto, CA 95356-9322 Fresno, CA 93726-0244 Bakersfield, CA 93301-2373
(209) 557-6400 • FAX (209) 557-6475 (559) 230-6000 • FAX (559) 230-6061 (661) 326-6900 • FAX (661) 326-6985
www.valleyair.org
