CONDITIONS OF APPROVAL <br /> MS-93-114 <br /> Harmohan Sohi, et al <br /> Unless otherwise specified,all Conditions of Approval and ordinance requirements shall be complied <br /> with prior to recording the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Division. <br /> Those conditions followed by a Section Number or other Statutory Requirement are based on <br /> ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT <br /> a. The distance between the homesite parcel to the east and Parcel 1 shall be reduced to <br /> zero or increased to 330 feet or greater. Parcel 1 shall have a minimum width of 150 feet. <br /> (Development Title Section 9-610.2) <br /> b. Parcel 1 shall be between 2 net acres and 5 gross acres in size. (Development Title <br /> Section 9-610.3[a]) <br /> C. The following note shall be placed on the Parcel Map and also recorded as a separate <br /> instrument: <br /> • In accordance with Section 9-610.3 of the San Joaquin County Development Title <br /> for the creation of homesite parcels, these parcels (including any remainder) <br /> cannot be further subdivided. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Development Title Section 9-915.2) <br /> b. The remainder shall be designated as •Designated Remainder' on the Parcel Map. <br /> (Subdivision Map Act Section 66445) <br /> C. The Traffic Impact Mitigation Fee will be required when the parcels are developed. The <br /> fee is due and payable at the time of building permit application. The fee currently is <br /> $3,175.00 per single-family dwelling unit in the Lodi area. The fee shall be automatically <br /> adjusted July 1 of each year by the Engineering Construction Cost Index as published <br /> by the Engineering News Record. (Resolutions R-90304 and R-91-1025) <br /> d. The frontage improvements for Mettler Road across Parcel 1 shall be constructed in <br /> conformance with the standards for one-half of a 50-foot-wide right-of-way rural road. The <br /> construction of the frontage improvements will be deferred upon execution by the owner <br /> of a Deferred Frontage and Roadway Improvement Agreement or a Secured Deferred <br /> Frontage and Roadway Improvement Agreement with a deposit equivalent to the <br /> estimated construction costs prior to approval of the Parcel Map. A$260.00 fee currently <br /> is required for processing, per Development Title Table 9-249.2, in addition to a copy of <br /> Conditions of Approval - 1 - MS-93-114 <br />
