Analysis <br /> Background <br /> On June 17, 1999, the Planning Commission voted 5 to 1 to approve Use Permit No. UP-96-0002. One <br /> commissioner was absent. No one spoke in opposition to the project. <br /> On May 7, 2001, Phase 1, classrooms, church administration offices, youth room, assembly room, and 100 <br /> parking spaces, was completed. Grading for Phase 2 has been started. <br /> Findings <br /> Development Title Section 9-878.4(b) states that for amendments to conditions of Use Permits, the Planning <br /> Commission must find that all of the findings required for the discretionary application under consideration are <br /> true. <br /> A current Use Permit requires the same five findings as in UP-96-0002. The previously approved findings are <br /> still true for the changes proposed for Condition 1.b. The extension of time for the completion of Phases 2 <br /> and 3 from seven years to twelve years does not require a change to the findings. Therefore, the previously <br /> approved findings are still valid. <br /> Council of Governments <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP). Participation in the SJMSCP satisfies requirements of both the state and federal <br /> endangered species acts, and ensures that the impacts are mitigated below a level of significance in <br /> �. compliance with the California Environmental Quality Act (CEQA). Participation in the SJMSCP is voluntary. <br /> However, if the applicant chooses not to participate, then alternative mitigation in an amount and kind equal <br /> to that provided in the SJMSCP will be required. <br /> The SJMSCP was not in effect at the time of application of the original Use Permit. A referral was sent to the <br /> State Department of Fish and Game on March 25, 1999. The Department did not respond and did not <br /> impose any conditions on the project. The SJMSCP was established on December 7, 2000. Projects within <br /> specified pay zones that are approved subsequent to that date may participate in the SJMSCP or provide <br /> alternative mitigation.
