Analysis <br /> Background <br /> The applicant is currently under enforcement for operating a farm services business without the necessary <br /> permits. <br /> Land Use Compatibility <br /> The parcel to the east is in agricultural use, the parcels to the north are agricultural with scattered <br /> residences, and the parcel to the south is fallow land. These parcels to the east, north, and south have a <br /> zoning of AU-20 and a General Plan designation of R/L. The parcels to the west are within the city limits of <br /> the City of Escalon and zoned for residential use. <br /> Neighborhood Opposition <br /> As of March 16, 2004, there have been a total of 109 persons who have either signed a petition or sent a <br /> letter in opposition to this project. This item, which would ordinarily be processed at staff level with <br /> notification, is being referred to the Planning Commission because of the significant level of opposition. <br /> The opponents have raised the following issues: <br /> Odor/Flies: It is recommended that, to minimize the impacts due to any odors emanating from the <br /> trucks, the trucks and trailers be parked a minimum of 80 feet from the nearest adjacent residence. <br /> Noise: After consulting with the applicant, he has agreed that to avoid noise levels that may be <br /> detrimental to the quality of life for the neighbors, the approved hours of operation for the farm <br /> services business will be from 6:00 a.m. to 9:00 p.m. A masonry wall six to seven feet in height will <br /> be required to be built along the property line abutting the adjacent residences to the west of the <br /> parcel (Development Title Section 9-1022.4[d][1]). With the construction of this wall, noises coming <br /> from the operation of the farm services business will not be expected to have a significant impact on <br /> the neighboring residences. <br /> Pollution/Dust: The driveways and maneuvering areas will be required to be surfaced with asphalt <br /> concrete or Portland cement concrete to provide a dust-free surface (Development Title Section 9- <br /> 1015.5[e][2][a]). This requirement will reduce dust levels to a minimum due to the movement of the <br /> trucks. <br /> Aesthetics: The applicant will be required to build a solid masonry wall six (6) to seven (7) feet in <br /> height along the property line abutting the adjacent residences to the west of the parcel (Development <br /> Title Section 9-1022.4[d][1]). This will shield any objectionable views of the trucks and trailers from <br /> the first floor of the neighboring residences. <br /> Roads: The Public Works Department has determined that, based on the applicant's description of <br /> his operations, the number of trips generated by the trucks on a daily basis will not have a significant <br /> impact on the roads in the area. <br /> General Plan and Zoning <br /> The Farm Services use type may be conditionally approved in the AU-20 zone with an approved Site <br /> Approval application. In order to make the findings for a Site Approval application, the project must be <br /> consistent with the General Plan, which is R/L (Low Density Residential).
