Ford <br /> PO Box 902 <br /> Linden, CA 95236 <br /> PROPERTY OWNERS'WATER LICIpNSE AGREEMENT <br /> This Agreement is entered into on the date sot forth at the end by and between Gerald W.Ford <br /> and Leslie T.Ford,Ken D.Ford and Shirley J.Ford(collectively referred to as the"Owners"),and <br /> relates to the real property identified as parcel Map filed for record_ ,2009, <br /> Book ,Page ,San Joaquin County Records(collectively referred to as Parcel Map),Parcel I <br /> located at 1156 N.Pine Road, Linden,CA 95236 and Parcel Map,Parcel 2 located 2152013.Milton Road, <br /> Linden,CA 95236. <br />{ 1. Recitals., <br /> a. The two parcels related to the Property abutt each other; <br /> 1 b. The common water supply for Parcel 1 relates to a we]I(the"Well")located on <br /> Parcel 2, located on the Parcel Map,and <br /> e. The water supply for Parcel 1 is provided via pipeline constructed from the Wall. <br /> 2. Grant and Confirmation of License Rights. <br /> a. Lieeuse. The Owners agree and grant to each other and appurtenant to and for the benefit <br /> two abutting parcels related to Parcel 1,license rights in the Well and the related water pipeline for ingress <br /> and egress rights over parcel I for the sole purpose of providing water,maintaining,and improving the <br /> Well and pipeline for each of the parcels related to Parcel 1. <br /> b. No_uexelttsive License, The license granted to each of the Owners is nonexclusive. The <br /> Owners retain the right to make any use of their property that does not interfere unreasonably with the other <br /> Owner's use and enjoyment of the license. <br /> f <br /> c. Teronination of Licerme, The Owners*glee that upon the sale or transfer o£either parcel <br /> related to Parcel 1,the license granted herein will terminate,and the owners agree that Parcel l <br /> will be required to have an approved independent domestic water supply well as a condition of escrow. <br /> d, Aindigg Effect. This Agreement shall be binding on and shall inure to the benefit of heirs <br /> executors,administrators,successors,and assigns of each of the Owners, <br /> i <br /> e. Entire Aeresment,Amendment. This Agreement constitutes the entire agreement betwt <br /> the Owners and supersedes all prior discussions,negotiations,and agreements whether oral or written.
