MS-92-169 (DISTRICT 4) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors uphold the Planning Commission's action to deny Minor Subdivision <br /> Application No. MS-92-169. <br /> REASON FOR RECOMMENDATION <br /> On October 22, 1992, the Planning Commission held a public hearing on this item. Joseph Rishwain, <br /> attorney for the applicant, spoke in favor of the project. Attorney Jerry Ruiz, representing Patsy <br /> Rasmussen Cox, spoke in opposition. Also speaking in opposition were Terry Prichard, Gordon Nelson, <br /> Gene Bartolomei, Ralph Lida and John Chiappe. <br /> After considering all testimony, the Commission denied the item by a vote of 7-0. <br /> On November 2, 1992, Khurshid Khan appealed the Planning Commission's action to the Board of <br /> Supervisors. <br /> Appeal Statement <br /> In his appeal, Mr. Khan indicates that the staff report was unclear concerning the amount of land planted <br /> in walnuts. He indicates that only 20 acres are planted in walnuts and 17.8 acres are fallow. He further <br /> states that row crops will be planted very soon in the fallow area. <br /> Response <br /> The project description in the staff report incorrectly states that the entire site is planted in walnuts. The <br /> error was corrected during the presentation of the staff report. The Commission determined that Mr. Khan <br /> was not actively farming the site; and his attorney stated that Mr. Khan intended to sell Parcel 2, which <br /> includes most of the walnut orchard. <br /> BOS LETTER PAGE 1 <br />
