The Major Subdivision application has been tentatively scheduled for the Planning <br /> Commission hearing on February 16, 2006. The Community Development Department <br /> has reviewed the project and responses from other agencies and will be recommending <br /> denial based on the inability to make Finding No. 6 in the affirmative. <br /> If the project is approved, the following Conditions of Approval are likely to apply <br /> Major Subdivision Application No. PA-0500492 was approved by the Planning <br /> Commission on . The effective date of approval is . This tentative map approval will <br /> expire on , which is three (3) years from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with and (2) a Final Map has been filed <br /> with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be complied with prior to approval of the Final Map. Those Conditions followed <br /> by a Section Number have been identified as ordinance requirements pertinent to <br /> this application. Ordinance requirements cannot be modified and other ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Rick Griffin, (209] 468- <br /> 3154) <br /> a. TENTATIVE MAP: The Final Map shall substantially conform with the approved <br /> tentative map dated December 13, 2005. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the <br /> following note shall be placed on the Final Map: <br /> All persons purchasing lots within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural <br /> operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin <br /> County has determined that such inconveniencies or discomforts shall not be <br /> considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to <br /> this map: <br /> (1) All parcels shall have a minimum lot width of 130 feet, measured a distance of <br /> (20 feet back from the front lot line. (Development Title Section 9-310.4) <br /> (2) All parcels shall have a minimum lot area of two (2) acres. (Development Title <br /> Section 9-310.3) <br /> d.
