San Joaquin Valley <br /> Air Pollution Control District JAN 2 2 2002 <br /> 0 Communiry uevelopmert 0 ,,, <br /> Jeff Fisher January 17, 2002 <br /> San Joaquin County <br /> Community Development Department <br /> Development Services Division <br /> 1810 East Hazelton Avenue <br /> Stockton, CA 95205 <br /> SUBJECT: SA-01-94 NEW FUELING FACILTY <br /> Dear Mr.Fisher: <br /> The San Joaquin Valley Air Pollution Control District (District) has reviewed the above <br /> referenced project and offers the following comments: <br /> The San Joaquin Valley's air quality has been designated nonattainment by the EPA <br /> and by the Air Resources Board (ARB) for 03 (ozone) and PM-10 (fine particulate <br /> matter, dust). The Federal Clean Air Act (CAA) and the California Clean Air Act require <br /> areas that are designated nonattainment to reduce emissions until standards are met. <br /> Based on the information provided, it appears that the proposed project will have a less- <br /> than-significant impact on the ambient air quality. Therefore, a negative declaration is <br /> appropriate from an air quality perspective. However, the construction phase of this <br /> project can generate emissions from the movement of soil, use of heavy equipment, _ <br /> bulk materials handling, asphalt paving and other related activities. As a result, this <br /> project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The <br /> purpose of Regulation VIII is to reduce the amount of fine particulate matter (PM-10) <br /> entrained into the ambient air from man-made sources. The attached Synopsis <br /> highlights many of the requirements contained within Regulation VIII. The Synopsis is <br /> not meant to be all-inclusive, but it can be a useful compliance aid in the field and office <br /> alike. Regula`4on VIII has recently been revised, with the revisions become effective <br /> May 15, 2002. The applicant may review these changes at the District web site <br /> www.valleyair.org. <br /> This project will be subject to the permitting requirements of the District. Any <br /> equipment subject to the District's Permit to Operate requirements must obtain an <br /> Authority to Construct (ATC) from the District. Construction of equipment that requires <br /> an ATC or construction of any intimately related appurtenances, such as foundations <br /> and utility hookups for the equipment, cannot begin until an ATC is obtained.
