San Joaquin Valley Air Pollution Control District JAN 2 2 2002 0 Communiry uevelopmert 0 ,,, Jeff Fisher January 17, 2002 San Joaquin County Community Development Department Development Services Division 1810 East Hazelton Avenue Stockton, CA 95205 SUBJECT: SA-01-94 NEW FUELING FACILTY Dear Mr.Fisher: The San Joaquin Valley Air Pollution Control District (District) has reviewed the above referenced project and offers the following comments: The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by the Air Resources Board (ARB) for 03 (ozone) and PM-10 (fine particulate matter, dust). The Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated nonattainment to reduce emissions until standards are met. Based on the information provided, it appears that the proposed project will have a less- than-significant impact on the ambient air quality. Therefore, a negative declaration is appropriate from an air quality perspective. However, the construction phase of this project can generate emissions from the movement of soil, use of heavy equipment, _ bulk materials handling, asphalt paving and other related activities. As a result, this project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose of Regulation VIII is to reduce the amount of fine particulate matter (PM-10) entrained into the ambient air from man-made sources. The attached Synopsis highlights many of the requirements contained within Regulation VIII. The Synopsis is not meant to be all-inclusive, but it can be a useful compliance aid in the field and office alike. Regula`4on VIII has recently been revised, with the revisions become effective May 15, 2002. The applicant may review these changes at the District web site www.valleyair.org. This project will be subject to the permitting requirements of the District. Any equipment subject to the District's Permit to Operate requirements must obtain an Authority to Construct (ATC) from the District. Construction of equipment that requires an ATC or construction of any intimately related appurtenances, such as foundations and utility hookups for the equipment, cannot begin until an ATC is obtained.
