III. COUNTY COUNSEL <br />1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br />subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br />and employees from any claim, action, or proceeding against the local agency or its agents, <br />officers, or employees to attack, set aside, void, or annul an approval of the local agency, <br />advisory agency, appeal board, or legislative body concerning a subdivision, which action is <br />brought within the time provided for in Section 66499.37 of the Government Code. <br />IV. PUBLIC WORKS (Staff Contact Michael Callahan, 468-3000) <br />1. All easements of record shall be shown on the Final Map (Development Title Section 9- <br />910.20). <br />V. SAN JOAQUIN COUNCIL OF GOVERNMENTS (Staff Contact Erin Sickler, 209- <br />468-3913) <br />1. In order to participate in the San Joaquin Multi -Species Habitat Conservation and Open <br />Space Plan (SJMSCP), the developer shall complete the following steps to satisfy SJMSCP <br />requirements: <br />a) Contact the San Joaquin Council of Governments (SJCOG) to schedule a SJMSCP <br />Biologist to perform a pre -construction survey prior to any ground disturbance. <br />b) Sign and return to SJMSCP staff of SJCOG the Incidental Take Minimization Measures <br />(given to the developer by SJMSCP staff after the pre -construction has been completed). <br />c) Pay to SJCOG the SJMSCP fee based on SJMSCP findings. <br />d) Upon paying the SJMSCP fee, receive from SJMSCP staff the Certificate of Payment. <br />VI. AIR POLLUTION CONTROL DISTRICT (Staff Contact Jessica Willis, 559- <br />230-5818) <br />1. An Indirect Source Review application shall be submitted prior to or concurrent with the final <br />discretionary application with San Joaquin County. <br />VII. ENVIRONMENTAL HEALTH DEPARTMENT (Staff Contact Nassem <br />Ahmed. 209-468-3436) <br />1. Refuse, garbage, and other solid waste material must be removed and transported to an <br />approved disposal facility in accordance with San Joaquin County Ordinance Code, Section <br />5-2400. <br />Note: Provide Environmental Health Department receipt of removed solid waste materials <br />before recordation of the final map. <br />40 <br />
