Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Mitigated Negative Declaration; and <br /> 2. Approve Site Approval application No. PA-1200023 with the Findings and Conditions of <br /> Approval contained in the Staff Report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the Utility Services-Major use type may be <br /> conditionally permitted in the AG-40 zone (General Agriculture, 40-acre minimum) zone <br /> with an approved Site Approval application. The project site has a General Plan <br /> designation of A/G (General Agriculture). The AG-40 zone is an implementing zone of the <br /> General Agriculture designation of the General Plan. The proposed solar array presents <br /> no significant General Plan policy issues; there are no Master Plan, Specific Plan, or <br /> Special Purpose Plans applicable for this site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because the proposed site is an open, fallow 22.3-acre parcel <br /> that contains one single-family residence. The project is an unmanned facility that does <br /> not generate noise or pollutants. The access gate off of Jack Tone Road will be recessed <br /> so that maintenance vehicles can be clear of Jack Tone Road before stopping to open the <br /> gate. There will be an 8-foot security gate around the perimeter of the project. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the, 22.3-acre parcel can easily accommodate the 20- <br /> acres of solar arrays, all ancillary equipment, and the existing single-family residence. The <br /> site has direct access to Jack Tone Road and access to the 12 kV PG&E distribution line <br /> across Jack Tone Road. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This Finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts. There are conditions of approval to satisfy <br /> the San Joaquin County Multi-Species Habitat Conservation and Open Space Plan (SJMSCP <br /> with the Council of Governments) and to pay a Traffic Impact fee and a Regional Traffic <br /> Impact fee to the Department of Public Works. The conditions of approval ensure that the <br /> impacts from this project will be less than significant.
