Jack Tone Road <br /> Stockton, CA 95215 Stockton, CA 95215 <br /> WATER CODE SECTION 13267 ORDER FOR REPORT, CHINCHIOLO FRUIT/SIERRA HILLS <br /> PACKING,STOCKTON, SANJOAQUIN COUNTY <br /> Staff has recently reviewed Chinchiolo Fruit Company and Sierra Hills Packing Company's self- <br /> monitoring reports and noted violations of the Waste Discharge Requirements (WDRs). The violations <br /> are described below: <br /> • Flow measurements are not reported or are reported at extreme flow rates. No reliable flow rates <br /> have been reported through the third quarter 2001. The reported rates vary from "ND"to <br /> "13,850,400 million gallons per day." hi 7 September 2000 correspondence, the Regional Board <br /> required Chinchiolo Fruit/Sierra Hills to meter the flow rate as required by the Waste Discharge <br /> Requirements. Over a year later,the flow metering has not been accomplished. By 7 December <br /> 2001, Chinchiolo Fruit/Sierra Hills shall submit a report describing the repair and calibration of the <br /> flow meter. Further failure to monitor the flow rate may result in additional enforcement action, <br /> including administrative civil liabilities. <br /> • Chinchiolo Fruit/Sierra Hills failed to perform monitoring of the soil quality as required by the <br /> Monitoring and Reporting Program. This monitoring was not performed despite the 17 April 2001 <br /> correspondence from the Regional Board to Mr. Borsdorf of Chinchiolo Fruit/Sierra Hills which <br /> transmitted the WDRs and stated, "Please note that in addition to regular monitoring of effluent, <br /> the WDRs require soil monitoring prior to cherry processing season. If you have not made <br /> arrangements for the monitoring you should do so immediately." By 7 December 2001, <br /> Chinchiolo Fruit/Sierra Hills shall submit a report describing the soil sampling and analytical <br /> results. If the sampling has not yet been performed, Chinchiolo Fruit/Sierra Hills shall immediately <br /> perform the sampling. <br /> Section 13267 of the California Water Code states, "In conducting an investigation specified in <br /> subdivision (a), the regional board may require that any person who has discharged, discharges, or is <br /> suspected of discharging, or who proposes to discharge waste within its region, or any citizen or <br /> domiciliary, or political agency or entity of this state who has discharged, discharges, or is suspected of <br /> discharging, or who proposes to discharge, waste outside of its region that could affect the quality of <br /> waters within its region shall furnish, under penalty ofperjury, technical or monitoring program reports <br /> which the regional board requires.
