Analysis <br /> Background <br /> On July 16,1.998, the Planning Commission approved Use Permit No.`UP-98=0048.for.a large winery.to be <br /> built.in six phases,over age period. However,the,applicant states that`business conditions caused <br /> a delay in completing conditions of the previously approved project."The Recisions of Approved Actions. is,0 <br /> ten-year extension of time that would give the applicant enough time to complete the project as originally <br /> proposed.All previous conditions of approval still apply. <br /> Applications for Revisions of Approved Actions are reviewed by the'Review Authority which imposed the <br /> i � i application Revisions <br /> condition to be considered for amendment. Prior to apprav ng th s app ca for s ions of Approved <br /> Actions, the Planning Commission must make the Findings required for the original approval of the Use <br /> Permit. A ten year extension of time requires that Conditions of Approval 1.b. and 1.e. be modified to reflect <br /> 17 years instead of 7 years. All other conditions remain the same., This project still meets all Development <br /> Title requirements. Therefore, the original approved Findings still apply. <br /> -Council of Governments <br /> San Joaquin County is a signatory to San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP)_ Participation in the SJMSCP satisfies requirements of both state and federal <br /> endangered species acts and ensures that the impacts are mitigated below a level. of significance in <br /> compliance with the California Environmental Quality Act(CEQA). <br /> The Council of Governments was sent a referral on March 30, 2007. They responded in a memo dated April <br /> 23, 2007, which states that this project is subject to the SJMSCP and that this project is located within the <br /> unmapped area. The applicant may participate in the SJMSCP or provide alternative mitigation in an amount <br /> and kind equal to that provided in the SJMSCP. <br /> A portion of this project has already been completed under the original approval. A site plan dated March 27, <br /> k 2007,was submitted that indicates which buildings have been constructed and which buildings will be built in <br />' the future. Only new construction is eligible for participation in the SJMSCP. Previously constructed <br /> buildings are exempt from the requirement.
