r'\ _ _1 - i'
Recommendati
ons
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve a five-year Time Extension for Major Subdivision No.SU-01-0007 with the previously
approved Findings and Conditions of Approval contained in the staff report.
Previously Approved Findings
1. The proposed subdivision is consistent with the General Plan, any applicable Master Plan, Specific
Plan, and Special Purpose Plan and any other applicable plan adopted by the County.
• This finding can be made because the proposed subdivision is consistent with
Agricultural Land Objectives and Principals of the General Plan. Such subdivisions may
be conditionally permitted by the County's Development Title.
2. The design or improvement of the proposed subdivision is consistent with the General Plan and any
applicable Specific Plan or Special Purpose Plan.
• This finding can be made because the number and size of the lots proposed are allowed
under the General Plan and AL-5 zone designation.
3. The site is physically suitable for the type of development proposed.
• This finding can be made because the site is relatively level, regularly shaped, and of
adequate size to accommodate the single family residential development with private
septic tanks, water supply and drainage systems.
4. The site is physically suitable for the proposed density of development.
• This finding can be made because each parcel within the subdivision will meet the area
and width requirements of the AL-5 zone.
5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
• This finding can be made because an Initial Study prepared for this project found no
significant, adverse impacts on the environment or upon threatened or endangered
species. Furthermore, the Department of Fish and Game is requesting that the applicant
participate in the San Joaquin Multi-Species Conservation Plan (SJMSCP) or provide
alternative mitigation in an amount and kind equal to that provided in the SJMSCP.
San Joaquin County SU-01-0007\Le Baron
a.
