SAN JOAQUIN COUNTY <br /> COMMUNITY DEVELOPMENT DEPARTMENT <br /> •.c. 1810 E.HAZELTON AVE.,STOCKTON,CA 95205-6232 <br /> 4UFopN PHONE:209/468-3121 FAX:209/488-3163 <br /> December 20, 2001 <br /> MEMORANDUM <br /> TO: Development Committee <br /> FROM: Jeff Fisher f-Y <br /> Assistant Planner <br /> SUBJECT: MAJOR SUBDIVISION APPLICATION NO:SU-01-7 OF SANGUINETTI <br /> & ASSOCIATES (C/O LE BARON) <br /> The applicant has submitted the above referenced application proposing to subdivide an <br /> existing eighty (80) acre parcel into eight (8) parcels of approximately ten (10) acres <br /> each. <br /> The project site is located on the north side of Jahant Road, 700-feet west of Elliott <br /> Road, northeast of Lodi. <br /> The General Plan designation is Limited Agriculture and the zoning designation for this <br /> property is AL-5 (Limited Agriculture, 5-acre minimum parcel size). The surrounding <br /> land uses include residential and agricultural. There exists multiple 5-acre parcels to the <br /> west, east, and to the south of the project site (Small Farms Improvement Tracts) and <br /> larger agricultural parcels to the north. <br /> The current zoning of the property is AL-5 (Limited Agriculture, 5-acre minimum parcel <br /> size). Under this zoning, under normal circumstances, the applicant could propose 5- <br /> acre parcels. However, the subject property is currently under Williamson Act Contract. <br /> Properties under Williamson Act Contract are not permitted to be below 10 gross acres. <br /> Therefore, the applicant is proposing 10-acre parcels. <br /> The Department of Fish & Game has stated in a letter dated December 13, 2001 <br /> (attached) that the project will result in the conversion of 80-acres of open-space <br /> agricultural lands to nonopen-space use. Furthermore, the conversion of agricultural <br /> land will result in a significant negative effect by contributing to the cumulative loss of <br /> wildlife habitat. The Department of Fish & Game requests that the applicant participate <br /> in the San Joaquin Multi-Species Conservation Plan (SJMSCP) or provide alternative <br /> mitigation in an amount and kind equal to that provided in the SJMSCP. <br /> This application is tentatively scheduled to be heard by the Planning Commission on <br /> January 17, 2001.
