CONDITIONS OF APPROVAL PA-1000074 Dixon k Minor Subdivision Application No. PA-1000074 was approved by the San Joaquin County Community Development Department on May 28, 2010. The effective date of approval is June 7, 2010. This tentative map approval will expire on June 6, 2013, which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified, all Conditions of Approval and Ordinance requirements,shall be fulfilled prior to approval of-Ahe Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Mo Hatef, 209468-8477) a. TENTATIVE,UAP: The Parcel Map shall substantially conform with the approved tentative map dated May 16, 2010. b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall be placed on the Parcel Map and recorded as a separate instrument: (1) All persons purchasing lots within the boundaries of this approved map should be prepared to . accept the inconveniences or discomforts associated with agricultural operations or activities, such asrnoise, odors, insects, dust or fumes. San Joaquin County has determined that such inconvehiencies or discomforts shall not be considered to be a nuisance. c. LOT SIZE AICD WIDTH: The following lot size and width regulations shall apply to this map: M (1) All parcels shall have a minimum lot width of 200 feet, measured at the front-Yard setback line. (Development Title Section 9-610.4) (2) All parcels shall have a minimum lot area of 5.00 acres. (Development Title Section 9-610.2) 1 d. TREE PRESERVATION: Future. development on the parcel(s) shall be consistent with the requirementsZof the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). 2. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to-attack, set aside, void, or annul an approval of the local agency,I advisory agency, appeal board;' or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code. li 3.
