5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
• This finding can be made because the design of the subdivision or the proposed
improvements are not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat because the Initial Study prepared for
this project did not identify any known rare or endangered species or habitats or other
substantial environmental adverse effects.
6. The design of the subdivision or type of improvement is not likely to cause significant public health
problems.
• This finding can be made because any studies required by the Environmental Health
Department will address any issues with regard to public health. To ensure that San
Joaquin County standards are met for the on-site septic systems, a Surface and
Subsurface Contamination Report, Soil Suitability/Nitrate Loading Study, and percolation
tests shall be submitted and approved. For water standards, the existing water wells must
meet the requirements for water quality.
7. The design of the subdivision or the types of improvements will not conflict with easements acquired
by the public at large for access through or use of property within the proposed subdivision.
• This finding can be made because the design of the subdivision and the type of
improvements will not conflict with easements, acquired by the public at large, for access
through or use of the property within the proposed subdivision since there are no public
easements existing within this proposed subdivision.
8 Any land or improvements to be dedicated to the County or other public agency is consistent with the
General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the lands to be improved and dedicated to the County
for the proposed access roadways of Griffith Gate Lane and Brittany Lane are consistent
with the General Plan. There are no Specific Plans, Special Purpose Plans, nor other
applicable plans in the project vicinity.
9 The design of the subdivision provides, to the extent feasible, for future passive or natural heating or
cooling opportunities in the subdivision, as required by Government Code Section 66473.1
• This finding can be made because the design of the subdivision provides, to the extent
feasible, for future passive or natural heating or cooling opportunities in the subdivision,
as required by the Government Code, since the lots are large enough so that individual
dwellings can be situated to take advantage of solar orientation.
San Joaquin County PA-0400251\Griffith
Community Development Page 5
