(SA-94-28) Dear Mr. Martin: The San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD) has reviewed the project referenced above and offers the following comments: San Joaquin Valley's air quality has been designated nonattainment by the EPA and the California Air Resources Board for the following pollutants, PM10 (fine particulate matter) and O, (ozone). The California Clean Air Act (AB2595), requires areas that are designated nonattainment to reduce emissions 5% annually until standards are met. The District is concerned about the potential of this proposed use to create nuisance complaints from adjacent/downwind receptors. Measures should be taken to reduce the amount of odor related to animal waste, silage, waste water, etc. generated during the operation of the dairy. The District is obligated to respond to odor/nuisance complaints that may occur from this project. A concerted effort should be made to reduce project emissions during construction and operation, as outlined below: The following rule has been adopted by the SJVUAPCD to reduce emissions throughout the San Joaquin Valley, and will apply to your project: • District Regulation VIII - Fugitive Dust Rules is a series of rules designed to reduce PM10 emissions generated by human activity, including but not limited to construction, road building, bulk materials storage and landfill operations.
