REVISIONS OF APPROVED ACTIONS FOR QUARRY EX AVATION NO. -89-0003 OF FRANK <br /> ALEGRE CIO F.T G.CONSTRUCTION to amend Community Development Department Condition <br /> No. 1.a.of a previously approved Quarry Excavation (QX-89-0003)to extend the life of the quarry <br /> permit an additional 20 years. The continuation of the permit will allow for the ongoing maintenance and <br /> s stabilization of the levee along the San Joaquin River. The project site is located between Kasson Road <br /> i and the west bank of the San Joaquin River, 1.7 miles northwest of Durham Ferry Road, southeast of <br /> Tracy(Supervisorial District 5). <br /> Charles McCabe, president of Reclamation District 296,said no studies have been done about the flow of <br /> the river. <br /> Mark Myles, County Counsel,said they should go through the standard hearing procedure with the staff <br /> report and recommendation. <br /> Kevin Swanson,Senior Planner, introduced the staff report into the record. <br /> i PUBLIC HEARING OPENED: <br /># PROPONENTS: <br /> Tony Alegre, representing the applicant,the quarry is not causing flooding down the river, <br /> Chris Neudeck,the engineer for the applicant, said this project will not redirect the river. The levee was <br /> placed by the Department of Water Resources to keep the river on its original course. Erosion sediment <br /> occurs annually. The quarry is maintaining the configuration of the river. <br /> OPPONENTS: <br /> Johnny Cardoza said that high water years will cause the rimer to change course. <br /> Jed Cardoza, a trustee of Reclamation District 2075, said that erosion will occur. <br /> Tony Cardoza,representing San Joaquin Water District,said that sandbars are being built up near their <br /> pumps. I <br /> REBUTTAL: <br /> Tony Alegre said that in 1997 the levee broke. The pumps downstream were sifted up with sand. District <br /> 2075 wrote a letter which said that the Alegre operation was not the problem. <br /> PUBLIC HEARING CLOSED: <br /> Commissioner Mom said that the Central Valley Flood Protection Bureau has no problem with this project. <br /> Commissioner Nickerson said he agrees. <br /> MOTION: <br /> It was moved, seconded (Johnson/Villapudua), and passed by a unanimous roll call vote(40)to: <br /> 1.
