not interested in excavation work for profit. Some of the soil
removed would be used for the farm. In order to get the fish ponds
functioning, some of the soil would have to be sold.
Comm. Rojas asked about a guarantee for the completion of the fish
pond project. Mr. Hooper said they would like to have phasing for
the development. He commented about the possibility of bonding.
Director Davisson noted that there were no bonding requirements in
the staff report because the conditions do not allow removal of
land from the site.
PUBLIC HEARING CLOSED
Chief Deputy County Counsel Mike McGrew said that this project has
been approved and the applicant is appealing the conditions. If
the Commission is going to permit the removal of soil from the
site, there will have to be a determination on site protection.
Comm. Morri said he felt that this is a quarry operation; that the
soil should not be removed from the property; and the soil that had
been removed should be brought back.
Chair Carter said that land owners should be good stewards of the
land.
Comm. Rojas said that the applicant, as a farmer, should have noted
prior to buying the parcel that the sand would be a deterrent to
farming. He objected to the removal of the dirt.
Comm. Jungeblut said that the history of the Dry Creek river bottom
is that of flooding and depositing of debris. He said he felt this
was a quarry excavation to remove dirt from the property. He did
not feel that a fish farm for black bass would be feasible here.
MOTION: Moved, seconded (Rojas-Morri) and carried by a vote of (-j
to denyhe of itions of SA-N92-41.
1 (1) , 4 (a)
VOTE:
Ayes - Jungeblut, Holly, Morri, Demichelis, Zunino, Rojas, Carter
Noes - None
Absent - None
-------------
----------------------------
APR 1, 1993
PC MINUTES -9-
