PC: 3-18-93 <br /> SA-92-41 <br /> k. The toe of the slope of all the ponds shall be maintained a distance of 10 feet from the <br /> nearest property line. (Development Title Section 9-1045.4) <br /> I. No soil shall be removed from the site. A note to that effect shall appear on the <br /> Improvement Plan, along with calculations regarding the amount of soil involved in the <br /> grading and excavation of the ponds. <br /> M. One copy of an Improvement Plan shall be submitted to the Development Services <br /> Division. The Improvement Plan will be distributed to the involved County departments <br /> for approval. The Improvement Plan shall be prepared by a registered Civil Engineer and <br /> show drainage, driveway access details, on-site parking, existing and proposed utility <br /> services, and grading. (Development Title Section 9-884.2) <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. An encroachment permit shall be required for work within the road right-of-way. (Streets <br /> and Highway Title Section 10-3103) <br /> b. The boundary of the 100-Year Flood Zone and Dry Creek shall be delineated on the <br /> Improvement Plan. No stockpiling of excavated material is allowed within the 100-Year <br /> Flood Zone. No excavation within Dry Creek is allowed until all applicable permits, <br /> including the San Joaquin County Flood Control District, have been obtained. (Planning <br /> Title Section 9-10324, 9-10325) <br /> 3. PUBLIC HEALTH SERVICES: <br /> a. No excavation is permitted into the groundwater table without specific approval from the <br /> Regional Water Quality Control Board, Central Valley Region. (Porter-Cologne Water <br /> Quality Control Act, Chapter 4, Article 3, Section 13240) <br /> b. The materials from an excavation shall not be deposited into any water course nor in any <br /> way contribute to the pollution thereof. (California Water Code, Section 13376) <br /> c. Provide an approved potable water supply for all employees. <br /> d. Provide approved sanitary facilities for all employees. (Ordinance Code Section 5-3001) <br /> e. The project will be operated so as not to cause a vector nuisance. <br /> 4. CALIFORNIA STATE DEPARTMENT OF FISH AND GAME: <br /> a. A plan shall be prepared in consultation with, and shall meet the approval of, the <br /> Department of Fish and Game (DFG). The plan shall provide for a habitat management <br /> agreement with the DFG that will ensure a highly productive foraging habitat in perpetuity <br /> for Swainson's Hawk. The habitat protection, replacement, and management plan shall <br /> comply with the DFG's'Mitigalion Guidelines for Swainson's Hawks in the Central Valley <br /> of California (1992)' and provide any replacement foraging habitat as close to the site as <br /> -20- <br />
