APPLICATION-DEVIATION <br /> SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT <br /> Findings 7rS�S y3 ? <br /> The following findings of fact must be made by the County before a Deviation can be granted. Indicate what facts in the <br /> case of this application support each of the findings. <br /> 1. The granting of the Deviation will not be materially detrimental to other properties or land uses in the area. <br /> The granting of the Deviation will be consistent with other properties in the area and with what this property <br /> would have been entitled to had Paddy Creek not been constructed. <br /> 2. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended uses it <br /> do not apply to other properties in the same zoning district in the vicinity. <br /> Land was not lost to Paddy Creek construction on other properties in this zone. Other sectionalized 80 acre parcels <br /> (original size)should also be entitled to the same considerations of properties not subjected to land acquisition by the State. <br /> 3. The strict application of the regulation deprives the property of privileges enjoyed by other properties in the vicinty. <br /> There are many properties in the immediate vicinity of this property that are 40 acres or less in size. <br /> 4.
