s x. CULTURAL. RESOURCES: The excavator shall cease all construction and excavation work immediately upon the discovery of cultural resource material. Such work shall cease until the excavator has complied with the requirements of Appendix K of the CEQA Guidelines. y. INDEMNIFICATION: The owner shall defend, indemnify, and hold harmless the local agency or its agent and employees from any claim, action or proceeding against the local agency or its agents, officers, or employees to attach, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning this Quarry Excavation permit. z. SEDIMENTATION POND DIKE DESIGN:A registered engineer shall design the proposed sedimentation pond dike. The design of the dike shall be reviewed and approved by an independent engineering or geo-technical firm selected by the Community Development Department. Said review shall be at the expense of the applicant. No more than fifty(50)acre feet of water shall be stored against said dike. 2. DEPARTMENT OF PUBLIC WORKS a. The excavation plan shall be prepared by a Registered Civil Engineer and include the following: (1) Detail of access road(first 100 feet from either Koster Road or Blewett Road shall be paved. (2) Haut route. (3) Stockpile area for topsoil. (4) Any stockpile or excavation shall be 25 feet clear of the Koster Road right-of-way. b. Loads shall be restricted to legal loads only. (Streets and Highway Title Section 10-2350) I'I c. A video tape of road conditions on Koster Road, Blewett Road, and Bird Road, along the haul route, is required prior to the start of excavation. The condition of these roads shall be reviewed with the Department of Public Works prior to the start of excavation and every five years thereafter. (Development Title Section 9-1415.2) d. A Maintenance Agreement to ensure that Koster Road (including bridges), Blewett Road, and Bird Road are maintained to a condition acceptable to San Joaquin County shall be exec�cvuted b finalized between the applicant and the County. The Traffic Impact Mitigation fee will be required for this development. The fee is due and payable at the time of building permit application. The fee currently is$168.90 per daily trip-end in the Tracy area. The fee shall be automatically adjusted July 1 of each year by the Engineering Construction Cost Index as published by the Engineering News Record.
