DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. ' Approve the Negative Declaration; and <br /> r <br /> 2. Approve Revisions of Approved Actions Application for Quarry Excavation Application <br /> No. QX-96-1 with the Findings in the Staff Report and Conditions of Approval in <br /> Attachment"A". <br /> BACKGROUND: <br /> f On September 4, 1997, the Planning Commission certified Environmental Impact Report No. ER-96-3 <br /> and approved Quarry Excavation No. QX-96-1 to remove 29,750,000 tons of material over a 56-year <br /> period. This action was appealed by the applicant due to traffic related issues. The Board of Supervisors <br /> upheld the appeal on October 30, 1997. The Planning Commission approved a one-year Time <br /> Extension on April 15, 1999. <br /> The project is a Revisions of Approved Actions Application for approved Quarry Excavation No. QX-96-1 <br /> to modify Community Development Department Conditions of Approval No. 1.u., regarding the pond <br /> levels. The application also includes the relocation of the sedimentation ponds to the east side of the <br /> project site during Phase 1 and the construction of a dike around the pond to increase capacity. Details <br /> of the proposed revisions are contained in the Staff Report. <br /> Originally, the applicant also requested to modify Community Development Department Condition 1.n. <br /> and Public Works Conditions of Approval No. 2.a.(1), 2.c., 2.d., 21, and 2.g., regarding access. These <br /> requests were withdrawn by the applicant on June 15, 2000, the day of the Planning Commission <br /> meeting (Attachment"B"). The request to modify Community Development Department Condition No. <br /> I 1.n., regarding phasing,was.withdrawn because the Community Development Department determined <br /> that the operation will comply with the existing condition. The request to modify Public Works conditions <br /> regarding access was withdrawn because the existing conditions already allow for the desired access, <br /> and the applicant anticipated opposition to the request. <br /> The proposed Revised Conditions are enclosed (Attachment "A"). <br /> 80.5 LETTER PAGE 1 <br /> f <br />
