Appeal Statement No.3: <br /> "In 1989 the area in which the Proposed Project is located was designated b the Board of Mining <br /> p 1 g Y 9 <br /> and Geology as an 'area of regional significance.' The Board adopted Section 3550.14, <br /> 'Construction Aggregate Resources, Stockton-Lodi Production-Construction Region,'which <br /> provides as follows: <br /> The.construction aggregate deposits in the following areas are designated as being of <br /> regional significance: <br /> Sector A-Aggregate deposits on the alluvial fan created by Corral Hollow Creek, <br /> situated south of the City of Tracy. <br /> Sector B-Aggregate deposit on the alluvial fan created by Lone Tree Creek. <br /> Deposit extends from just west of Interstate 580 near the base of the Coast Range <br /> hills northwest to the alignment of Interstate 5. <br /> Sector C-Aggregate deposit that consists of the alluvial fan formed by Hospital <br /> Creek. Deposit extends from west of Interstate 580 within the foothills of the Coast <br /> Range and east into the San Joaquin Valley. <br /> Sector D-Sand deposit centered on the San Joaquin River near the intersection of <br /> i Highway 120 and Interstate 5 west of the City of Manteca. <br /> "Note that the policy of the State is to strongly discourage the development of incompatible uses on <br /> parcels of land that either(1) contains protected resources or(b) is adjacent to land that contains <br /> protected resources. That is, the State recognizes that the approval of an incompatible use, such <br /> as a residential use, on land adjacent to protected resources would have a negative impact on the <br /> extraction of those resources." <br /> Response to Appeal Statement No.3: <br /> The Community Development Department concurs that the parcels are designated significant mineral <br /> resource areas. However, upon review of all agency responses, it was determined that the construction of <br /> four(4)residences would not prohibit or negatively impact existing or potential quarries from excavating <br /> surrounding sites and extracting resources. All project'parcels are contiguous to Koster Road, the Delta <br /> Mendota Canal, or an existing residence and do not share common property lines with parcels undergoing <br /> excavation or planned for excavation. <br /> Appeal Statement No.4: <br /> "In acknowledgement of State law and regulations and the underlying policy considerations, the <br /> County's General Plan explicitly recognizes that new development generally does interfere with <br /> the mining of sand and aggregate. As quoted in the Initial Study, the General Plan specifically <br /> cautions that new development should not be allowed to impinge on the mining of these <br /> resources: <br /> "Because these resources are limited, it is important that new development not be <br /> allowed to prevent their extraction. Extraction usually involves large land areas and <br /> large-scale disruption of the landscape. Extraction activities often are characterized by <br /> noise, dust, vibrations, heavy truck traffic, visual blight and water pollution. These <br /> characteristics can resent problems for most adjacent uses."
