In this <br /> 1 P application, <br /> allowing residential uses will inevitably lead to conflicts with adjoining property owners who <br /> do wish to extract these mineral resources. California land uses history is rich with <br /> examples of homeowners objecting to and seeking to prevent or minimize mining <br /> activities." <br /> Response to Appeal Statement No. 5: <br /> This Site Approval will not result in a loss of significant resource materials. in general practice, quarry <br /> operations consist of much larger areas. Volume I of the General Plan (C. Extractive Resources, pp. VIA 5) <br /> states that extraction usually involves large land areas and large-scale disruption of the landscape. <br /> Appeal Statement:No. 6: <br /> "Approval of the Site Development Application would lead to substantial conflicts between the future <br /> residents and the mining activities. <br /> "Finding#4: The issuance of the permit will not be significantly detrimental to the public health, <br /> safety, or welfare, or be injurious to the property or improvements of adjacent properties. <br /> I <br /> "The State of California and the County of San.Joaquin, through its General Plan, have established <br /> a policy of protecting these mineral resources. The public welfare will be substantially compromised <br /> to the extent that these mineral resources are not protected. In addition, incompatible land uses on <br /> adjacent properties clearly will be injurious to the mining properties. <br /> "Please also note that the Del Puerto Water District has gone on record expressing concern about <br /> the incompatibility of the proposed project with surrounding uses. In addition, the District has stated <br /> that the Proposed Project is not eligible to receive water from the District. Robert N. Raspo, the <br /> owner of a neighboring property, has indicated that`the water quality for domestic wells is <br /> substandard and the quantity is unreliable.' There is no indication in the County file that the <br /> Applicant has been required to demonstrate that availability and quality of water from the proposed <br /> well." <br /> Response to Appeal Statement No. 6: <br /> Development may be permitted in the project area with an approved Site Approval. Upon review of the <br /> Site Approval, it was determined that the construction of four (4) single-family residences would not be <br /> inJurious to the public or mining properties. In a telephone conversation with the Del Puerto erto Water District, <br /> it was revealed that the purpose of their response was to inform the owner that a Groundwater Management <br /> Plan was in effect in the project vicinity. Because the properties were originally owned by the United States <br /> as part of the right-of-way for the Delta-Mendota Canal, they are considered to be non-irrigable lands and <br /> are ineligible for water service from the District. The District also indicated that the Groundwater <br /> Management Plan is not expected to affect the ability to obtain groundwater for domestic use.
