Mr. Reeds stated the railroad loaned the City a copy of the report, but <br /> currently the City did not have a copy of the report. <br /> Council Member Sundberg stated she would like to see what the samples <br /> revealed to know what type of containment was required. <br /> Council Member Tolbert stated it was not known among Council or the <br /> community as to what type of project was needed at the site and without <br /> consensus among the citizens the City was not in a position to begin expending <br /> money for testing, decontamination or purchase. Mr. Reeds reminded the <br /> Council that there was a budget item in the CIP for a Central Tracy Urban Design <br /> and Specific Plan that would allow the City to determine what the uses on the <br /> entire Bowtie area should be. <br /> Council Member Tucker stated it was premature to spend money until it is <br /> decided what to use the property for. <br /> Council Member Sundberg stated she did not vote to approve the budget <br /> because it did not include funds for the Bowtie area. <br /> Mayor Pro Tem Ives asked if there was a specific plan scheduled in the <br /> 2005/2006 budget. Mr. Reeds stated yes. Mayor Pro Tem Ives stated the City <br /> should wait until the specific plan was completed. <br /> C. City Council direction regarding the provision of water service to vacant <br /> properties in the Larch Clover Area - Bill Reeds, Director of Development and <br /> Engineering Services, provided the staff report. At the City Council meeting of <br /> April 19, 2005, direction was provided by the Council regarding future <br /> annexation requests in the Larch Clover area. With regard to the provision of <br /> water service to vacant properties in the area, as part of the district formation to <br /> implement sewer improvements, the City committed to provide one Equivalent <br /> Consumer Unit (ECU) upon payment of fees to vacant parcels upon annexation. <br /> The failure of the annexation application and the delay of the construction of the <br /> sewer line left this commitment unresolved. There are two proposed assembly <br /> uses that want to proceed with construction. One proposed assembly use <br /> proceeded to prepare construction documents based on the assumption that the <br /> annexation would be successful, a "will serve' letter provided by the City <br /> (subsequently revoked after the failure of the annexation), and that the sewer <br /> system would be installed this year. <br /> Although staff had previously reported that the County was not allowing the use <br /> of septic systems in the area, it is now staffs understanding that the County is <br /> amenable to allowing temporary sewer systems. <br /> There is an existing agreement dating back to 1986, between the City and the <br /> County that specifies water service will be provided only for residential uses in <br /> existence at the time the agreement was entered into, i.e. not new uses. <br /> At the April 19 meeting, Council indicated an interest in considering a policy <br /> change to allow the provision of water to vacant properties in the Larch Clover <br /> area, possibly on a case-by-case basis, if the County would allow temporary <br />
