City staff can <br /> manage and implement the policy and requests. <br /> Council Member Tolbert asked for clarification of the phrase "a case-by-case <br /> basis" and if that referred to the agreement between the City and the County. <br /> Mr. Reeds stated yes. <br /> Pastor William Roland, 55 Shakespeare Court, addressed the Council on behalf <br /> of the People of Christ Church, and urged the Council to grant water to the site <br /> so construction of the church could proceed without further delay. <br /> Pastor Roger Rickman, addressed the Council in support of the provision of <br /> water to the Larch Clover area. <br /> Mark Humphries, 277 James W. Smith Drive, addressed the Council in support <br /> of places of assembly being given certain considerations. <br /> Carlton McAllister, 30 Hawthorne, addressed the Council in support of churches <br /> in Tracy. <br /> Deacon John Ryan, 163 Eaton Avenue, addressed the Council in support of the <br /> free practice of religion, which includes affordable space. <br /> Robert McMillan, 2931 Georgia Court, stated he supported the specific request of <br /> the People of Christ Church receiving water service. <br /> Council Member Sundberg asked for clarification regarding the notice and <br /> subsequent rescission. Mr. Reeds stated the letter was rescinded because there <br /> was no means to provide sewer because the sewer line was delayed, although <br /> since that time the County has stated they will allow temporary systems until the <br /> sewer line is complete. Mr. Reeds added that because the property was not <br /> annexed, the existing policy was in place. <br /> Council Member Sundberg asked if there was a problem for the sites to receive <br /> sewer and water. Mr. Reeds stated there was still a problem with sewer, but that <br /> the applicants would have to satisfy County requirements. Mr. Sharma added <br /> the reason for the rescission of the will serve letter was due to the failure of the <br /> annexation. Currently, was no mechanism to allow the connection. <br /> Council Member Tucker asked if the agreement extended to current residents <br /> only of the Larch Clover area. Mr. Reeds stated it was to the uses on the property <br /> that were done at the time of the agreement. Council Member Tucker asked how <br /> many homes water was being provided to. Mr. Sharma stated current residents <br /> have water along with a few non-residential properties. <br /> Debra Corbett, City Attorney, stated the 1986 agreement indicated that the City <br /> agreed to provide water to existing uses, not to vacant properties. Ms. Corbett <br /> stated the resolution for consideration would provide unimproved areas with one <br /> unit of water. <br />
