, Jan 11 2007 9: 40AM Chesney Consulting (209) 668-2598 P. 5 <br /> 01-02-2907 15:26 W C Ra-LAN PAGE5 <br /> 14 <br /> RESOLUTION <br /> APPROVING THE PROVISION OF CITY WATER SERVICE TO VACANT PARCELS IN THE <br /> LARCH CLOVER AREA <br /> WHEREAS,the Larch Clover area in unincorporated San Joaquin County is wthin the <br /> City of Tracy's Sphere of Influence, and <br /> WHEREAS, the City of Tracy agreed to provide water to the existing residents of the <br /> area under an agreement between the City and the County dated August 5, 1906, and <br /> WHEREAS, In November of 2003,the property owners In the Larch Clever area (armed <br /> an assessmerd district 10 provide City sewer service to the area, and <br /> WHEREAS, as a part of the district formation to implement sewer improvements, the <br /> City committed to provide water (One Equivalent Consumer Unit)upon payment of fees to <br /> vaunt parcels upon annexation, and <br /> WHEREAS,the annexation application was rejected, and <br /> WHEREAS,there are a smell number of property owners desiring to construct buildings <br /> that would require a potable water supply of no more than one Equivalent Consumer Unit <br /> (ECU). <br /> and WHFRFA.S, the number of such buildings that could be constructed is no more than 30, <br /> WHEREAS. provision of water service la no more than 30 buildings would have a <br /> minimal impact on the City's ability to provide water to the City as a whole, <br /> NOW, THEREFORE BE IT RESOLVED That the City Council finds that the provision of <br /> water to vacant properties within the Larch Clover area is consistent with the agreement <br /> between the City of Tracy and the County of San Joaquin approved August 5, 1986 if the <br /> following criteria are met <br /> V 1. The parcel to which water will be provided is vacant as of the date of adoption <br /> "'2 <br /> of the resolution. <br /> ' 2. There Is an existing water IMe in the street or road adjacent to the property. <br /> p/13- The proposed land use is single family detached residential or equivalent not <br /> requiring more than one Equivalent Consumer Unit(ECU) of service and not <br /> requiring a water service connection greater that one inch in diameter as <br /> / governed by the California Building Code. <br /> 4. The proposed land use Is consistent with San Joaquin County zoning <br /> requirements. <br /> 5. The applicant presents building construction plans to the City for purpose of <br /> determination that the use will not require more than one ECU. <br />
