Analysis <br /> Background <br /> The Lathrop Irrigation District (LID) was formed in November 2002 by the San Joaquin County Local <br /> Agency Formation Commission (IAFCO) to provide irrigation water, wastewater disposal, potable water, <br /> electrical, and under certain conditions, telecommunication services. The LID currently contains 234 acres <br /> within the Stewart Tract area in the City of Lathrop and provides irrigation water to this area. The LID is <br /> proposing annexation of 4678.32 acres of land within its adopted Sphere of Influence. In addition to <br /> irrigation water services, the LID would ultimately provide electrical and telecommunication services to <br /> residences and businesses within the River Islands planning area of the City of Lathrop. <br /> Negative Declaration <br /> San Joaquin County is acting as lead agency for the preparation of a Negative Declaration for this project <br /> pursuant to Public Utilities Code Section 9607(e), which states: <br /> "Any project involving electric transmission or distribution facilities to be constructed or installed by an <br /> irrigation district to serve retail customers located in the service territory of an electrical corporation <br /> providing electric distribution services shall comply with the California Environmental Quality Act <br /> [Division 13 (commencing with Section 21000)] of the Public Resources Code. The County in which the <br /> construction or installation is to occur shall act as the lead agency." <br /> Pacific Gas and Electric Response <br /> Correspondence was received from Pacific Gas and Electric regarding the Negative Declaration. PG&E <br /> contends that the Negative Declaration is inadequate and that an EIR should be prepared. Issues raised by <br /> PG&E include the following: <br /> • Duplication of services by the LID. <br /> • Electric construction projects can have significant environmental impacts. <br /> • Use of the River Islands EIR to address impacts from the installation of electric facilities. <br /> • Lack of adequate mitigation measures. <br /> The applicant and County Counsel are reviewing these issues. <br /> San Joaquin County PA-0500408/1-athrop Irrigation District <br /> Community Development Page 3 <br />
